Question from User:-revi,
Subject: Usage Change of the term of public Nuri license
I wish the prosperity of your organization.
On the term of the statement: “2. The terms of the original licence of ”Public-Nuri” product may be changed, but if the user has used it before the change of the terms, he/she should be able to continue to use the specific product(or file) without following the new licence rules after the term of KOGL licence change."
This is how I understand this provision:“The users who have already used the product before changing the term of KOGL licence should be able to use the product with Public Nuri-1 type licence”. In this case, Would you please clarify what it means when MCST allows the User’s further entitlement which is the freedom to redistribute the product with the public Nuri-1 type licence without retroactive effect?
Answer from (MCST)Ministry of Culture, Sports and Tourism of Korea Government
1. Hello, this is a response to your inquiry via public Q&A bulletin board from Ministry of Culture, Sports and Tourism's duty.
2. We understand that your question is about the "Original license agreement validity after KOGL license change".
3. Our response is as follows.
가(A). Public institutions such as the state, local governments, etc must promote the usage of public works (note: defined as Copyright Act of Republic of Korea,).
However, we can not predict when a KOGL License might change. If and when it does, public institutes must announce the change of the license, but all antecedent licenses granted by the user is kept intact without retroactive effect.
나(B). However, if the reason of the license change is due to a violation of the "Public Works management and usage guideline" article 15 (copied below), then the public institute may request to apply for a new license or stop distributing the materials.
For example, KOGL licensed material may copyright the material which is also partially copyrighted by a third party. When the third party requests changes of the license, public institutes may have to follow the change to protect the third party license.
※References: (Public Works management and usage guideline), article 15:
(Cease of distribution of Public Works)
① Chief of the Public Institute may request the users to follow the revised term of license or stop distribution in following case:
1. Violating KOGL license term
2. KOGL usage infringes 3rd party's right
3. The requirement of the type of KOGL license should be changed
4. There is a dispute regarding Public Works' distribution and usage.
5. Abuse of KOGL material in illegal purposes.
② In such case, Chief of the Public Institution must publish the cease of distribution to public via the homepage, and notify it to Minister of Culture, Sports, and Tourism.
4. Hope this helps, and in case of further question, please contact the copyright department of the Ministry of Culture, Sports and Tourism
Thank you. END.
